This privacy policy sets out how KIDStory Ltd (“KIDStory”,”we”, “us” or “our”) treats the privacy of those who use our website kidstory.mu, its subdomains and or any other domain or subdomain giving access to the Service ("Website", “Site” or “Application”). This document is our most recently updated Privacy Policy which is reviewed from time to time to keep pace with changes in our service. We take privacy very seriously and are committed to dealing with personal information in accordance with the requirements of the Data Protection Act 2004 (MU).

Please be aware that KIDStory provides its services, to Centres (any Person, School, Kindergarten, Parent Teachers Association (PTA) or any institution providing early childhood education and/or childcare and/or services for children collectively known as the “Subscriber”), where the relevant Subscriber will be the "data controller" and KIDStory will be its "data processor". This means that the relevant Subscriber is responsible for ensuring compliance with data protection law, including where we process personal information on its behalf (such as when subscriber or any person authorised by it to use the Application (“User”) record information and upload documents/images to our service).

We have in place an agreement with each Subscriber that requires us to act only on the relevant Subscriber's instructions. Therefore, if you are User of the Application, please contact the relevant Subscriber for further information and to exercise your data protection rights.

Please take a moment to read this Privacy Policy so you understand how we collect, store, use, disclose and protect your personal information.

By providing your personal information to KIDStory, you agree and consent that we may collect, store, use and disclose your personal information in accordance with this Privacy Policy.

1        Application

This Privacy Policy applies to all personal information obtained by KIDStory, including, but not limited to when submitted by users through the Website.

2      Collection and Storage of Personal Information and Data

By accessing the Website, all such Users consent to the collection, use, disclosure, storage and processing of their information in accordance with this Privacy Policy.

We may collect personal information (being information about a person from which their identity is apparent or can reasonably be determined). This information can include names, dates of birth, email addresses, home and work addresses, telephone numbers, photographs and Special Categories Personal Data (as defined in privacy legislation). It can also include such information (where applicable) about a child, including a child to whom a KIDStory profile pertains ("Child"). We will collect such information by lawful and fair means and not in an unreasonably intrusive way. We may collect personal information in circumstances including:

  1. From you directly when you provide information to us;

  2. When a Centre signs up or registers to use the Application;

  3. When profile information including photograph of an individual is loaded into the Application by an employee or agent (each a “Staff”) authorised by the Subscriber to do so. Without limiting this, subject to our Terms of Use, there may be circumstances when a Child may be photographed in connection with educational or related activities (including incidentally) with another such Child, which photograph is subsequently posted on a KIDStory account;If materials created by a Child include such personal information and are loaded into the Application by a User authorised by the Subscriber;

  4. When profile information in relation to a Child, is submitted by the child, parent or guardian or family member authorised by the Subscriber or its Staff to do so;

  5. In respect of “Special Categories Personal Data” when such information is submitted in relation to a profile by authorised Users through the Application;

  6. When you interact with us on social media, visit our website and send an enquiry through or make a comment or other post at the Website;

  7. When we meet with an organisation wishing to do business with us (and an individual from that organisation provides personal information about themselves); and

  8. When evaluating job applicants and personnel which may include collection of details such as employment history and educational qualifications. This may include “Special Categories Personal Data”.

3      Use of Personal Information

We use personal information about Users for the purpose it was provided or collected, including in the following ways:

  1. For the purposes of the collection described in 2 above, including to enable the features of the Application to be utilised and enjoyed, subject always to our Terms of Use. This may, for example, entail incidental posting of photographs of one Child on another Child’s profile (as referred to in 2c above), which posts may remain able to be viewed even once a given Child no longer attends a given Centre as long as the Child’s KIDStory profile is retained;

  2. To respond to enquiries received from you;

  3. To verify your identity;

  4. To communicate with you and provide you (including through functionality provided with an Application) with information (whether by email, post or other means) about our services, where you have requested or consented to receiving this from us.

  5. To notify you about changes to our services;

  6. To receive and address feedback or complaints from you;

  7. Incidentally, where Staff, may view, some content of a profile to which a Subscriber has lawful access;

  8. To protect our legal interests and fulfil our regulatory obligations (if and to the extent necessary); and

  9. In other circumstances, with your prior consent.

We take steps to regularly destroy data (being personal information and Special Categories Personal Data) that does not need to be archived and to de-identify stored data where identification of a person is not reasonably required or necessary.

4      Disclosure of Personal Information

We will not sell Personal Information to anyone. All Information recorded in a KIDStory account subscribed by a Subscriber is only disclosed to Staff and Users authorised by the same Subscriber.

We may also disclose your personal information to third parties outside our organisation:

  1. If KIDStory or substantially all of its assets were acquired by a third party, in which case personal information which we hold may be one of the transferred assets (subject to the same constraints on use and disclosure as under this policy); and

  2. If we are under a duty or have a legal right to disclose or share personal information in order to comply with any legal obligation, or in order to enforce or apply our terms and conditions or to protect our rights, property, or the safety of our personnel and users. This includes exchanging information with the relevant authorities for the purposes of fraud protection.

We deal with third parties that are required to meet the privacy standards required by law in handling your personal information, and use your personal information only for the purposes that we give it to them.

Transborder data flows

The vast majority of personal information we handle is stored and hosted in the United States. All personal information relating to users and children on KIDStory is hosted in the United States. In that respect, KIDStory shall ensure that the relevant data protection laws and/or regulations in the United States afford to the data subjects concerned protection to the right of privacy similar or equivalent to the protection enjoyed by the said data subjects under the laws of Mauritius.

KIDStory’s head office is located in Mauritius, so some limited information about adult individuals (including customers) is transferred and /or stored there.

While the information resides outside of the territory where you reside, it may be accessible to the local courts, law enforcement and national security authorities in a foreign jurisdiction.

5      Security of personal information

We take all reasonable steps to protect personal information, including through internal and external security, restricting access to personal information to those who have a need to know, maintaining technological products to prevent unauthorised computer access and regularly reviewing our technology to maintain security. We choose technology partners based on their security and privacy policies and practices.

Personal information stored in our system is protected by electronic and procedural safeguards. We take reasonable precautions to protect personal information (and other content) from accidental loss and theft. Communication between Users and our servers is encrypted via industry-standard secure sockets layer (SSL).

The Application is protected by a secure and encrypted password that each User must choose themselves. Users should never share their passwords. KIDStory is not responsible for any loss of data or breach of privacy if a User shares their password with someone else. We do not store your password on our servers.

KIDStory takes all reasonable precautions to protect your data. Because internet transmissions cannot be guaranteed to be 100% secure, you acknowledge and agree that you use this service at your own risk.

6      Statistical Information and Tracking of Online Activity

We may collect statistical (non-personal) information about your use of the Website and Application to improve the features and overall experience for our Users. The information KIDStory may collect includes statistical information such as pages accessed on the Website and Application, search terms, links that are clicked on, Website and Application visit times, browsers and operating systems, IP address, and cookies.

We do not collect any of our Users’ personally identifiable information pertaining to their activity over time and across other websites or online services.

7      Cancelling your Account

A KIDStory account can only be cancelled by the Subscriber. When a KIDStory account is terminated (for whatever reason), the personal information associated with it will no longer be accessible.

8      Changes to our privacy policy

We may modify, alter or otherwise update this privacy policy at any time. We will post revisions on our website. We encourage you to review this policy from time to time.

9      Complaints

You have the right to lodge a complaint with the Data Commissioner through the Data Protection Office. For more information about your rights under the new Data Protection legislation, please consult the Data Protection Office website: http://dataprotection.govmu.org.
